Despite having no authority to control owner elections, the board put limits on nominations that blocked Jay Lund, an extremely well qualified owner's nominee, from the owner's board of director's ballot. Who do you think benefits from that?
The board has no authority under the master deed or bylaws to regulate who can be nominated for the board or to establish procedures that inhibit owners' right to elect anyone they choose. This newsletter is informed that Jay Lund, one of the managing members of the TTCA's single largest owner, Greenslate Development, submitted his nomination form at about 5:00 pm on December 16, about an hour after the board's 4:00 pm deadline. As an experienced Midtown developer, Mr. Lund is obviously an extremely well qualified candidate for the TTCA board. The board's deadline was a meaningless one. The board was supposed to reveal the nominees on Tuesday, December 20, however, they violated their self-imposed deadline and didn't reveal the nominees until Wednesday. What mischief was taking place between the nomination deadline and the revelation to owners? Why didn't the board simply extend the deadline? Why is there any deadline at all? Enforcing their unauthorized rules and barring a well qualified candidate like Mr. Lund certainly seems to serve the self-interest of the board members sitting for re-election. The board's actions are inappropriate. Owners remain free to elect anyone they choose at their meeting--and to write in anyone they want.
